Students or Professionals Sharing A Property

Tom Perrett explains the rules governing students or professionals sharing a property.

From a point of view of licensing, when you have two or more occupiers in the property, you fall into HMO within Swansea and the district specific areas, or compulsory HMO licensing. 

So for a start it would have to be a licensed property.  We don’t flaunt the rules, we deal with hundreds of HMO’s and we wouldn’t want to flaunt the rules. The rules are there for their safety so when you have  multiple people, there’s a lot more to go wrong in a property from a point of view of fire risk and safety generally. 

So first of all we would advise them that you are going to be looking at an HMO property and when they come down we do ask the questions.  We want to know what they’re doing, are the studying, are they professionals because there’s different things for council tax. 

For example, a landlord renting to students full time will be exempt; a landlord renting to professionals the council will bill the landlord directly, they will not deal with the tenants.

So we have to think a few steps ahead and we have to actually agree with the tenants that they pay a supplementary fee for that or it’s rolled into the rent, whichever way it’s structured.  So they come down and we put them in and the beauty of our service is that we’re like chauffeur drivers as well. 

Full Service

We have 7 seater vehicles.  So they’ll come down, we arrange it, we prefer for them to come to the office, have a chat with them, see how they are, have a cup of tea. 

Then we hop in one of our bright orange vehicles, called the fun buses, and we head out around the areas wherever we’re going.  We’ll show them two, three, four, however many available properties and we’ll take them door to door.

It’s like a big thing.  We get to know them, they get to know us.  We’re building a confidence in the service.  We give them feedback on why one house might be this and why you might prefer that one.  Where this is, what’s local because they may not be from around here. 

So it’s the full service really but from the point of view of the undertaking they are making, we make it very clear from the start that once you sign a legally binding tenancy agreement then that’s signed.  There are only in very extenuating circumstances when a landlord may choose to release them from the property.
